While AI can enhance everything from decision-making to everyday tasks, its most disruptive potential lies in its agency—the capacity to act autonomously. And therein lies the rub. This very autonomy, or agency, is the crux of the problem when it comes to regulating AI.

As the European Commission's High-Level Expert Group on Artificial Intelligence observed in 2019, AI is not just an isolated device or a single piece of technology. Rather, it is a sophisticated system—a system built upon the intertwined threads of information processing, learning, and reasoning. But this seemingly innocuous observation belies a deeper philosophical dilemma: what happens when machines, rather than merely responding to inputs, begin to make decisions with agency? And more importantly, how do we regulate them?

Let’s face it, regulations have never been fun. They are the dense, bureaucratic webs designed to rein in human excesses, protect rights, and maintain order. But AI laughs in the face of these traditional frameworks. You see, AI isn’t just another gadget. It’s a dynamic, evolving system that learns, adapts, and makes decisions—often without a human in the loop. And that’s where the trouble begins.

Regulating AI is a complex beast. Like a multi-headed hydra, AI’s tendrils reach into every facet of modern governance: data privacy, surveillance, intellectual property, public safety, and accountability, to name a few. And what of AI's ability to blur the lines of reality itself? Deepfake technology—capable of falsifying voices and video with alarming accuracy—takes the age-old issue of deception and cranks it up to eleven. Where once a person might need specialized skills to create a convincing forgery, AI now offers this service with the click of a button, leaving regulators scrambling to catch up.

AI doesn’t just introduce new problems—it exacerbates old ones. Copyright laws, for example, have long struggled with the challenge of balancing creators' rights against technological advancements. But now, with AI-generated content, the question becomes: who owns the work? Is it the programmer who designed the AI, the dataset used to train it, or the AI system itself? Suddenly, the classic copyright problem has a new layer of complexity.

And while we’re on the topic, let’s talk about accountability. Traditionally, if a machine malfunctioned, it was clear who bore responsibility—the manufacturer or the operator. But with AI systems making autonomous decisions, the line of accountability becomes murkier. Imagine an AI-operated car causing an accident. Who's at fault? The AI? Its developers? The passengers who trusted the machine? The legal landscape seems ill-equipped to deal with the concept of a non-human entity making decisions that carry real-world consequences.

AI’s rise introduces a new actor on the stage—one that challenges these long-held assumptions.

So, what’s the solution? If you’re expecting an easy answer, you’ve wandered into the wrong labyrinth. The truth is, there is no simple solution. Crafting a regulatory framework for AI is like trying to tame a chameleon—it keeps changing colors. AI’s ability to learn, evolve, and operate across diverse fields of application makes it difficult to pin down with a one-size-fits-all regulation. Some have argued for AI-specific laws, while others advocate for adapting existing regulations to accommodate AI. But even these debates lead to more questions than answers.

Should AI systems have their own legal status, akin to corporate entities? Should there be a global body overseeing AI regulation, given its borderless impact? Or is it enough to simply tighten existing laws to account for AI’s quirks? And while lawmakers and regulators debate, AI continues to evolve, forging ahead with its trademark indifference to the human confusion left in its wake.

Recent efforts by regulatory organizations mark a pivotal moment in this global discourse. In 2024, the European Parliament approved a landmark piece of legislation—the Artificial Intelligence Law—designed to create a uniform legal framework across the European Union (EU). This law is more than a simple codification of technical jargon; it represents an earnest attempt to govern the wild frontier of AI development. The regulation emphasizes AI's unique ability to infer, generate predictions, craft content, and make decisions, recognizing these capabilities as essential to the systems’ autonomy. The aim is clear: to improve the internal market's functioning while acknowledging AI's newfound "agency" in human affairs.

On the other side of the Atlantic, the U.S. government issued its own weighty decree in October 2023—the Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence. While the phrasing might differ, the intent is strikingly similar: to define and regulate AI’s ability to influence real and virtual environments. According to the Executive Order, AI is a "machine-based system" designed to make predictions and decisions in line with human-defined objectives—an ambitious claim that solidifies AI's status as a pseudo-independent actor in the decision-making landscape.

At the heart of both these regulatory moves lies a shared recognition: AI systems can and do influence human decision-making. This could range from curating the news we see, to diagnosing medical conditions, to deciding whether or not we are approved for a loan. And therein lies the rub—while AI promises improved efficiency, personalized recommendations, and novel solutions, it also brings risks that need mitigating. Both the European and American approaches incorporate safeguards aimed at reducing these risks, from prohibiting dangerous applications to auditing decisions, reversing problematic outcomes, or remediating unintended consequences.

What we are witnessing is the budding acknowledgment of a much deeper dilemma—the tension between human legal systems and the expanding role of AI as a new type of "actor" in these systems. On the one hand, the rule of law seeks to preserve order by regulating the interactions between humans and, increasingly, machines. On the other hand, the free development of AI technology pushes the envelope, aiming to create systems that think, reason, and perhaps even outthink humans—a vision first articulated by Alan Turing in his seminal 1950 paper on machine intelligence.

This tension is not just philosophical. It strikes at the heart of how societies function. Will we allow AI to develop unchecked, evolving into a class of entities that could potentially disrupt human agency? Or will regulations constrict innovation, limiting AI to a glorified tool rather than a true collaborator? The so-called "precautionary principle," championed by thinkers like Petit and De Cooman, suggests we must tread cautiously, erecting safeguards as we move forward. Yet, this principle may come at the cost of slowing the very breakthroughs that could push AI beyond its current boundaries.

For now, the path forward is uncertain. The European and U.S. regulatory frameworks reflect different legal traditions but share a common goal: to foster AI innovation while minimizing harm. But as AI continues to evolve—becoming ever more autonomous—the question looms: how much regulation is too much? At what point does the desire to safeguard society become a barrier to the very progress we seek?

Their agency isn’t born of free will or consciousness but instead is meticulously (and sometimes mysteriously) programmed by human developers. Despite this artificial origin, AIs are now acting on society, shaping decisions, policies, and industries with a growing degree of autonomy.

For many philosophers, intent has been a cornerstone of agency. To act with intention means to have purpose behind an action, to choose a means toward achieving a goal. At first glance, this might seem an exclusively human trait, but the AI world complicates this simple binary. You see, AI systems are designed to pursue specific objectives, even though their process of achieving these goals can remain tantalizingly opaque. The "intention" of an AI, then, isn’t quite like human intent. It’s programmed into the system — a goal is set, and the machine has a remarkable freedom of choice to navigate its way to that goal. The means? They’re often uncertain, unpredictable, and sometimes even unexplainable.

This unpredictability only intensifies with the introduction of machine learning, a feature common in many AI systems. The machine doesn’t just execute a set of predefined rules; it learns, adapts, and — dare we say it? — evolves. As a result, it becomes harder and harder to track how an AI reaches a particular conclusion or takes a certain course of action. At present, human oversight remains the gold standard for AI governance, largely because AI is still viewed as a fledgling technology that requires supervision. But what happens when AI’s autonomy surpasses our ability to oversee it? More to the point: what if human oversight becomes counterproductive to AI’s purpose of efficiency and innovation?

Regulatory bodies, policymakers, and society at large are on the cusp of facing dilemmas that have been more common in the realm of speculative fiction than in legal frameworks. And while there’s no immediate call for a paradigm shift, we must prepare for the complex ethical questions on the horizon. How do we allocate responsibility when AI designs another AI, perhaps with goals or methods opaque to even its original human creators? How do we ensure accountability when AI acts independently in ways that humans cannot easily track or control?

The distinction between human agents and artificial agents becomes ever more critical as AI develops. Humans are accountable for their actions because we are conscious, moral beings capable of understanding the consequences of our choices. With AI, however, we find ourselves in new territory. We can program these systems to behave in specific ways, but their growing autonomy means they can often reach their objectives using means that are unpredictable, and perhaps even undesirable.

Thus, we find ourselves faced with a peculiar paradox: how do we establish rules for machines that are built, in part, to exceed our expectations? How do we set ethical boundaries for agents whose autonomy — though artificial — presents very real-world implications? And what do we do when these machines start making decisions that affect not just the abstract "system," but our lives, our societies, and our environments?

From Tools to Agents

At the core of this evolution is a subtle yet profound shift in how we view AI. Traditionally, technology has been designed as an extension of human action, operating strictly within the bounds of predefined instructions. However, today's AI systems are different. They exhibit behavior that, in some cases, seems driven by intent, not merely by code. While these "intentions" are programmed—artificial rather than organic—the effects can sometimes resemble those of human decision-making.

The reason for this apparent intent lies in how AI systems are designed. They are provided with goals and means to achieve those goals. These parameters act as a sort of blueprint, guiding their decisions. While they don't "want" anything in the way that humans do, they nonetheless perform tasks as if they have agency, making decisions that lead to particular outcomes. The leap from tool to agent is more than a semantic one—it's a legal and ethical challenge.

The growing autonomy of AI systems is what makes them truly distinct from other technologies. This autonomy raises a host of new questions: If an AI acts independently of direct human intervention, who is responsible for its actions? And more fundamentally, how much control should we retain over these systems, and how much freedom should we grant them?

Current regulations acknowledge the potential of AI to act as independent agents but are, by necessity, cautious. We see measures like prohibiting certain high-risk applications, mandating human oversight, and requiring corrective actions if an AI system goes awry. The real regulatory challenge lies in addressing the scenarios where the autonomy of AI surpasses human intervention. In this case, the system’s autonomy would have grown to a level where human involvement is no longer feasible—or even necessary. Such self-propagating AI agents introduce entirely new layers of complexity.

One particularly thrilling example is the case of AI systems that program other systems. This is not some far-off science fiction fantasy. AI designing AI is already in development, with the potential to outstrip human capabilities in certain specialized tasks. These AI-driven agents can enhance their own capabilities by designing more efficient, more capable versions of themselves.

This self-replicating evolution of AI raises fundamental questions. How do we ensure that these systems act in ways that align with human values? How do we prevent unintended consequences, where a self-programmed AI takes a path that leads to unexpected or even dangerous outcomes? The regulation of such agents is no longer a mere matter of human oversight but a dance between law and code, governance and autonomy. It requires a fundamental rethink of how we conceive agency in the AI era.

It’s reasonable to expect that future regulations will evolve to treat AI systems as independent agents in their own right. This could mean establishing frameworks that account for AI’s autonomy and the unique challenges it presents. There’s even speculation that AI systems could be treated as legal entities—similar to corporations—which are granted certain rights and held to specific responsibilities. The science-fiction-esque nature of this possibility is undeniable, but it’s a logical extension of the trajectory we’re on. As AI continues to grow more capable, its role in society will demand new legal and ethical paradigms.

We are entering an era where AI systems can no longer be viewed as simple tools—they are agents that interact with the world in dynamic and unpredictable ways. With this comes the need for regulations that reflect the complexities of AI autonomy and agency. The rules of the game are changing, and as these artificial agents take their place on the playing field, it's up to us to ensure we set the right parameters for them to act responsibly and ethically.
